After a lengthy court hearing today, Judge Belvin Perry determined that the 911 calls made by Cindy Anthony will be admissible during the 2011 Casey Anthony murder trial. The pretrial hearing began at 2:00 p.m., ET and saw Lee Anthony and Cindy Anthony take the stand. It may be ironic, but the ruling indicates that Cindy Anthony’s own frantic words may be used against her daughter during her murder trial.

Nancy Grace transcript July 14

Part 3
BREMNER: Nancy, you know, those are two separate things the last time I checked, sending pictures to yourself versus having sex, doing the deed.

GRACE: Okay, you know what?

BREMNER: The fact is one of your other guests --

GRACE: I`ll throw you a bone. Put Bremner up. I`ll throw you a bone, all right?

BREMNER: Okay.

GRACE: You win, Bremner. She`s not having an affair. Let`s just pretend she`s not having an affair.

BREMNER: Okay.

GRACE: Why is she sending hundreds of sexual text messages and sexually explicit photos at a time when her stepson has just gone missing? There. Let me hear the answer to that. I can`t wait to hear this.

BREMNER: Let`s take a look at two scenarios. A, like someone just suggested, they were involved before the disappearance of Kyron.

GRACE: So.

BREMNER: Therefore they`re still involved. Second though is, Nancy - -

GRACE: Her son has just gone missing.

BREMNER: How is this relevant to anything and it --

GRACE: Her state of mind. Hugo, Hugo, Hugo, please, help Anne.

RODRIGUEZ: No, no, I can`t help you, Nancy. State of mind but not as to a crime concerning Kyron. That`s what the focus is. If they plan to charge her with anything concerning her son it is totally irrelevant and not admissible. There`s no way you`re getting that in as a state of mind.

GRACE: You know what? I`m going to go -- I`m not talking about getting something in in court. I`m not talking about something that remote. Right now, Mark Klaas, I am talking about a 7-year-old little boy who is very likely dead, who very likely by all accounts, Terri Horman knows his whereabouts.

I`m talking about now to you, Mark Klaas, who lost your daughter to violence taken out of her own home. I don`t care what the shrink says. I don`t care what the lawyers say. I know what I know. And when your child goes missing, you`re not all about sending sexual texts and photos.

MARK KLAAS: No.

GRACE: I don`t care what any of you say about that.

KLAAS: No, you`re absolutely right about state of mind. I`d like to put a context on the supposed -- or the attempted abduction out of the gym. As I understand it, Kaine had moved out two days previously and he had taken the little girl with him. She knew full well where the child was, but according to the conversation that she had with the gym clerk, she was willing to go in and snatch that little girl away without his permission or without his knowledge.

That in my mind, whether legally or not, is a kidnapping, and this gal was ready to do a high-risk kidnapping to get that little girl away from that man. And as far as I`m concerned, that`s very relevant to the disappearance of Kyron himself. It`s almost in many ways a similar scenario, without any rhyme or reason, without any care about anything but her own immediate needs, she`s willing to make a little girl or a little boy disappear.

GRACE: Mark Klaas, listen. I don`t care who sends what photos over their cell phone as long as I don`t have to look at them. What I`m saying is something about this most recent report that we have just discovered about this mother, this stepmother -- I mean this child is so defenseless.

He`s a 7-year-old little boy, 3 feet tall, 50 pounds, his eyeglasses are like the bottom of coke bottles, and she was entrusted to take care of him, to love him. And within a -- it`s like a minute after she reports him missing, she`s sending sex messages.

KLAAS: She cares about -- she cares about nothing besides herself. This is classic narcissistic behavior without consideration for the consequences. It`s narcissus. It`s sociopathic. There`s nothing good about this woman, her motivation, her actions or the potential of future behavior in future crimes.

GRACE: I mean, Mark, when you`re sitting there right now like I`m sitting here listening to the defense attorneys talk about how it`s relevant, how it`s to going to come into court, how it doesn`t matter. It does matter. To every crime victim out there, you know in your heart it does matter. It proves something.

KLAAS: Of course, it does. And if you want to see how a mother behaves when a child disappears, just look at the other side of this coin. Look at the bio-mom. Look at every time she comes on TV. She begs for information. She says this is about Kyron, this is about Kyron, this is about Kyron. She`s not getting on her phone.

She`s not getting -- taking pictures of herself and send them to somebody. She`s not breaking restraining orders. She`s focused on finding her son and doing nothing more. You can tell that this woman is a complete emotional wreck who only wants to find her child. That`s how a parent behaves when their child is missing, particularly over the long term like this.

GRACE: Take a listen to Kyron`s mother.

(BEGIN VIDEO CLIP)

YOUNG: To know that I was four and a half hours away when he need me to protect him, that`s what I feel guilty for. The fact that I had to work that day instead of going to the science fair like I wanted to, that I feel guilty for too.

(END VIDEO CLIP)

GRACE: That`s Kyron`s biological mother, Desiree Young. She was on the NBC "Today" show and I want to remind everyone that Terri Horman has not been named a suspect by police in the disappearance of 7-year-old Kyron. Out to the lines, Chris in New Jersey. Hi, Chris.

CHRIS: Hello, Nancy, how are you?

GRACE: I`m good, dear. What`s your question?

CHRIS: Have the police given Michael Cook a polygraph yet?

GRACE: Good question. To James Pinken, reporter with The Willamette Week Newspaper, joining us out of Portland, Oregon. James, have they given him a poly?

PITKIN: Nancy he has had interviews with investigators. Whether a polygraph was involved, we`re not sure. But he did say to the public, to the press that they did not have sex. He denied that explicitly.

GRACE: Is he married?

PITKIN: It`s unknown. Not much is known about Michael Cook except that he was involved in the search for Kyron from very early on. He did organized a vigil. He helped put signs up above the highway. He told the press that he became better friends with Terri than he was with Kaine initially so they developed a relationship very quickly.

GRACE: Well, that`s certainly like putting perfume on the pig James Pitkin, by saying they developing a relationship. They were sending naked photos back and forth, James. I would certainly qualify that as more than just a friendship. I`ll be back with James Pitkin reporter with the Atlantic Week Newspaper, but as we go to break, I want to wish a very, very happy birthday to a friend of show, Kylie Barnes.

She`s the beautiful daughter of Karen Barnes who passed away last September and a late Atlanta Fulton County Superior Court Judge, Roland Barnes. He lost his life in that tragic courthouse shooting in 2005. A paralegal with two degrees in criminal justice Kylie wants to go to law school, and she`s writing a book about her father. They were best friends. Happy birthday, Kylie, and, please, stay strong.

(COMMERCIAL BREAK)

UNIDENTIFIED FEMALE: Shocking new allegations.

UNIDENTIFIED FEMALE: Bombshell tonight.

UNIDENTIFIED FEMALE: An alleged love triangle.

UNIDENTIFIED FEMALE: Stepmother Terri Horman.

UNIDENTIFIED FEMALE: A sexual relationship with Michael Cook. Who`s Michael Cook?

UNIDENTIFIED FEMALE: It`s only reasonable to assume that people would speculate and become suspicious of Terri.

UNIDENTIFIED FEMALE: Sexting.

UNIDENTIFIED FEMALE: Old school friend, Michael Cook.

UNIDENTIFIED FEMALE: Kyron we miss you, we love you, and we need you home right now.

UNIDENTIFIED FEMALE: New allegations step mom tried to kidnap her baby girl from dad`s gym day care.

UNIDENTIFIED FEMALE: New search is underway now for 7-year-old Kyron Horman.

YOUNG: I`m kind of at that point where I`m so angry I don`t even have words. I just really want her to do the right thing.

UNIDENTIFIED FEMALE: Please help us bring Kyron home.

GRACE: Out to Dr. Joshua Perper. Dr. Perper, searchers are focusing on an area near Skyline School. At this point if Kyron is dead, what would be the condition of his body?

PERPER: Well, it depends on what condition the body`s found, in what environment. If he`s unfortunately left on the surface of the earth, the decomposition is going to be faster. If the body is buried or if the body is put in some kind of container. So it depends in what kind of environment and what kind of protective clothing or other equipment the body is encased in.

GRACE: Another question, Dr. Perper, is that it has been suggested that Terri Horman may have suffered postpartum depression after the birth of the little girl. The little girl is about 19 months old. How long does it take for postpartum depression to set in?

PERPER: Well, the depression, the depression related to a pregnancy varies in lengths, but sometimes it appears only with the resolution of pregnancy. In other words after the child is born, and even then it can take several months. It depends on the general constitution of the individual, of the woman, and whether she receives treatment. But that`s a difficult problem because many women during pregnancy for a variety of biological and psychological reasons suffer a depression.

GRACE: To Jean Casarez, Jean, I want to go back to hiring the hit man to allegedly kill Kyron`s father. When did that allegedly happen?

CASAREZ: That happened late last year, November/December and we now know that`s the reason for the restraining order. Originally it was sealed but then it was unsealed. And Nancy, towards your state of mind, here`s something else. On June 28 when she went to try to abduct her own little girl, Kiara, their little girl from this gym day care, that`s also the time Michael Cook went over to the house, police searched his cell phone and found a cell phone image of the address where little Kiara would be with her father, and also they found on the cell phone Google map searches of where they were residing at that time.

GRACE: And that says to you they were going to try to get the little girl?

CASAREZ: Two state of minds that are the same. That`s exactly right.

GRACE: What I don`t understand, to Bruce McCain, former captain of the sheriff`s office, attorney, joining us out of Portland, Oregon, is why an arrest has not been made in the hiring -- the alleged hiring of a hit man to kill the husband.

MCCAIN: Well Nancy, as I mentioned last week on this very program, you know as well as I do big difference between probably cause and arrest and proof beyond a reasonable doubt to convict. The thing is the prosecutors are working hand in hand with the investigators. The DA is actually controlling this process. They`re not going to arrest Terri Horman for any felony unless and until they have an airtight case they can get a conviction on.

The last thing they want to do is arrest her on some chippy charge only to see her turn around and walk out of the jail with all the cameras on her. So that fact that she`s not been named a suspect or even a person of interest who as you know, has no legal significance at all, doesn`t mean she`s not the focal suspect in this case.

GRACE: What about it, Anne Bremner?

BREMNER: Well, I was just thinking to myself, hiring a hitman is not a chippy charge. But the other thing about it is you said before she`s not a suspect. She`s also not been named a person of interest. The fact of the matter is she`s as innocent as anybody else walking the street in Portland right now, and everyone is throwing stones at her.

GRACE: Please say something relevant.

BREMNER: I`m saying everything relevant.

GRACE: I asked why there has not been an arrest in the hitman case, and you`re talking about people looking at her on the street. I don`t care.

BREMNER: That`s not what I`m talking about. I`m saying everyone is dumping on her in terms of saying that she`s guilty with all kinds of irrelevant evidence. Evidence. And the fact is she has -- there`s been no arrest in the hitman case --

GRACE: Just because you Anne Bremner --

BREMNER: -- they don`t have the evidence. They don`t have the evidence.

GRACE: I know you`ve handled a lot of cases but just because you think the evidence is irrelevant doesn`t mean that it`s irrelevant.

BREMNER: You know what?

GRACE: Go ahead.

BREMNER: It`s so salacious. It`s not what I think. It`s what is going to be admissible in court and by the way, the standard right now the is probable cause. They don`t need proof beyond a reasonable doubt and they haven`t called her a person of interest at the --

GRACE: Thank you. I said that about ten times, that she`s not been named a suspect. Out to the lines, Dorian in Georgia. Hi, Dorian.

DORIAN: Hi, Nancy. I love your show.

GRACE: Thank you, Dorian. What`s your question, dear?

DORIAN Okay. Well, I was wondering, do they know the whereabouts -- Michael Cook`s whereabouts on the day that Kyron disappeared?

GRACE: Now that is a good question. What about it? To you James Pitkin with the Atlanta Week Newspaper. Where was Cook?

PITKEN: I talked to Kaine Horman. He said that he didn`t see Cook for years, only after Kyron disappeared did he contact the family wanting to help. So it`s uncertain where he was that day, even whether he was aware that the Hormans lived in the vicinity.

GRACE: And Michael Cook is the husband`s high school friend that has gotten hundreds of sexually-related text messages from the stepmother and dozen of sexually explicit photos sent over e-mail and phone. He says they`re not having sex.

Okay, we`re switching gears but I want to give you the tipline, . There`s a $25,000 reward. She`s been kept a prisoner. She has been bound, tied, and under constant surveillance, under 20 cameras. The kidnapper, her own husband.

UNIDENTIFIED FEMALE: A California man has been arrested for allegedly binding and beating his wife because she spoke to a, quote, unauthorized man. The victim told cops her husband would regularly beat her and wouldn`t let her leave the house, allegedly installing 20 surveillance cameras inside the house to monitor while he was away.

The wife reportedly told investigators her husband became angry after she spoke to another man, (inaudible), binding her with duct tape in the bathroom and threatening to kill her if the police got involved. The husband turned himself in Monday and was booked on charges including kidnapping and assault with a deadly weapon.

GRACE: Straight out to Ellie, our chief editorial producer. Ellie, what happened?

ELLIE: Nancy, police are saying that this 30-year-old victim suffered a brutal pattern of abuse and control at the hands of her own husband. Her friend who was concerned that she hadn`t heard from her, she called in sick to work, reportedly forced to do so by her husband. She went to the house, found this woman bound with duct tape, beaten, confined to the bathroom. This woman told police that the --

GRACE: Ellie, how can a grown woman be confined to the bathroom? It`s like me telling you to go sit in the corner?

ELLIE: Right. Well, apparently, Nancy, the husband threatened her with a knife, said he`d kill her if she called police or if she left the bathroom. They also say he had a very sophisticated surveillance system. Cameras set up all over the house which were streamed to his phone, possibly his iPhone we`ve heard from reports, and that he was monitoring her when he wasn`t home so he knew where she was every minute.

GRACE: So he could watch her in the home over his iPhone?

ELLIE: That`s right. And they say that he had this sophisticated system. He had fingerprint-activated door locks, over $10,000 worth of security and surveillance equipment in that home.

UNIDENTIFIED MALE: There`s a lot of emotional toll that will take place in a situation like this and the method and the mode was extremely brutal as far as I`m concerned.

(COMMERCIAL BREAK)

UNIDENTIFIED FEMALE: Police have arrested a California man after he allegedly beat his wife for talking to a, quote, unauthorized man, then duct-taped her and confined her to the bathroom of their home. Police were called after the wife`s friend found bound and beaten in the bathroom. The victim reportedly told cops her husband would frequently beat her and not even let her leave the house unless she was with him or going to work.

UNIDENTIFIED MALE: There`s a lot of emotional toll that will take place in a situation like this. The method and the mode was extremely brutal as far as I`m concerned.

UNIDENTIFIED FEMALE: Cops reportedly found 20 cameras installed throughout the house. The video feed allegedly going straight to the husband`s iPhone. The husband is now facing charges, including kidnapping, assault with a deadly weapon, false imprisonment and spousal abuse.

GRACE: Alreisa Sarjachari, age 31, charged with kidnapping and assault with a deadly weapon -- a knife, domestic battery, false imprisonment, criminal threats, witness intimidation. The victim? His own wife. This guy allegedly sets up a web of over 20 surveillance cameras on his own wife. Ellie, is it true that she would go to work and she never said anything to anyone?

ELLIE: Well, Nancy, he would not allow her -- remember, police say that this whole thing started because she spoke to an unauthorized man and that was why the husband became enraged, beat her, confined her to the house. He allegedly wouldn`t let her leave the house unless he was with her or she was going to work. She worked as a retail clerk we`re told.

GRACE: Is this guy American?

ELLIE: Don`t know that, Nancy, at this point.

GRACE: Did he also work, Ellie?

ELLIE: Yes, he did. He worked for a technology firm in Irvine. He`s a computer specialist we`re told.

GRACE: There`s a $150,000 bond. We are not naming the victim in this case. She`s a 30-year-old woman. The wife of the suspect. Let`s hope she is safe tonight. Let`s stop and remember army private first class David Simmons, 20. Kosovo, Indiana, killed, Iraq. From a long line of vets, awarded the bronze star, purple heart, loved the outdoors, hunting, fishing with his father, camping, baseball, go-karts, military history, favorite movies "Pearl Harbor" and "Saving Private Ryan." Remembered as everybody`s friend, with a smile that lit up a room. Leaves behind grieving parents David and Terry. David Simmons, American hero.

Thank you it to our guests but especially to you for being with us. I`ll see you tomorrow night. 8:00 sharp eastern. Until then, goodnight, friend.

Part 2

UNIDENTIFIED MALE: ... an affair with one of Kaine Horman`s friends...

UNIDENTIFIED MALE: He admits that they were friends. He did not have sex with her.

UNIDENTIFIED MALE: ... his wife and Cook had been having an affair.

UNIDENTIFIED FEMALE: There were texts. There were photos.

UNIDENTIFIED FEMALE: Her marriage started out as an affair.

UNIDENTIFIED FEMALE: I don`t want Kyron to come home and have all this other stuff out there.

(END VIDEO CLIP)

(COMMERCIAL BREAK)

UNIDENTIFIED MALE: Do you have anything to say? Do you know where Kyron is? Yes or no?

UNIDENTIFIED FEMALE: A little boy is missing...

UNIDENTIFIED MALE: ... missing Oregon boy Kyron Horman...

UNIDENTIFIED FEMALE: And she was the last person to see him.

UNIDENTIFIED MALE: Stepmom Terri Horman...

UNIDENTIFIED FEMALE: ... all these other twists...

UNIDENTIFIED FEMALE: Court documents suggest she came to the club looking to abduct her 20-month-old daughter, Kiara, from the gym day care center.

UNIDENTIFIED FEMALE: ... alleged murder-for-hire plot...

UNIDENTIFIED FEMALE: A landscaper claims Terri offered a large sum of money to kill her husband, Kaine.

UNIDENTIFIED FEMALE: Kyron`s father moved out, filed for divorce and got a restraining order.

UNIDENTIFIED FEMALE: In it, Kaine Horman said he believes his wife, Terri Horman, is involved in the disappearance of 7-year-old Kyron.

UNIDENTIFIED MALE: Right at this particular point, I think our detectives have got to -- they`re working on a very sound case.

UNIDENTIFIED FEMALE: ... waiting for that break that could come in the case at some point...

UNIDENTIFIED FEMALE: The focus is still to find little Kyron Horman.

(END VIDEO CLIP)

GRACE: Looking for a break in the case? What more do you need? We now have the stepmom, who says she walked 7-year-old Kyron to his door after the science fair, his door in the elementary school, there in a very rural area. She says he is never seen again. We now have her cell phone popping up in other areas than where she says she was, an alleged attempt to hire a hit man to kill Kyron`s father, her husband, now hundreds of text messages, sexually-related, dozens of sexually explicit photos she`s sending over the computer. And this is after Kyron goes missing?

To top it all off, Matt Zarrell, are you telling me she tried to kidnap the 19-month-old baby girl from day care? What more do police need!

ZARRELL: Yes, police told Kaine Horman that on or about June 28th, the same exact day she was served with the restraining order, just before she was served, she went to the gym where Kaine Horman works out and was asking if Kaine Horman was there with Kiara. Now, he wasn`t, but Terri Horman told the clerk at the gym that the next time he comes in with Kiara, she wants him to call her because she wants to come and take Kiara.

GRACE: Unleash the lawyers. Joining me tonight, high-profile lawyer out of Seattle Anne Bremner. Also Hugo Rodriguez, defense attorney, former fed, joining me out of Miami.

Anne Bremner, she allegedly tries to hire a hit man to kill Kyron`s father, and she thinks she can have custody of the baby? No! No, no! It doesn`t work like that, Anne Bremner!

ANNE BREMNER, DEFENSE ATTORNEY: Well, but Nancy, you said, Hand me a handcuff. I think you want a pair of handcuffs for her. But the fact is, one of these things is not like the others. You know, potentially hiring a hit man -- we don`t actual have proof of that, and that happened what, six months ago, supposedly? And then the child kidnapping? Uh-uh! The restraining order had yet to be served on her, so she had no legal requirement that she not take the child or be around the child.

And then, finally, when you`re looking at a supposed abduction of her own stepson, what kind of evidence do we really have? The last one that`s seen with him, yes. This is my part of the country, you know, Northwest. Everybody up here thinks she did it. But you know what? Is there evidence that she did it? I don`t know.

GRACE: Well, other than her lying to investigators...

(CROSSTALK)

GRACE: ... according to sources, Marc Klaas, about where she was after the child went missing.

MARC KLAAS, KLAAS KIDS FOUNDATION: Well, it`s one thing after another that just continues to pile up. And the whole problem is -- and this is what you`ve mentioned. The focus has to remain on finding little Kyron, and she`s just not giving up that information, which I believe is why they keep revealing ugly layer after ugly layer of her hideous behavior since the moment that he disappeared.

GRACE: You know, another issue. I want to go back to you, Jean Casarez. When she allegedly went to the day care -- which, number one, I don`t understand why the baby was in day care because she wasn`t working. So why is she, you know, stashing the baby in day care? But that`s a whole `nother can of worms. When she went to day care and told them to tell her, when he showed up with the baby, that she wanted to get the baby, when was the restraining order served on her in relation to that visit or that call to the day care?

CASAREZ: I think it was on the 28th, so I think it was the very same day the restraining order came down. Whether she had been served with it or not, I don`t know. But it was the day care that he works out at -- the gymnasium...

GRACE: Oh, it`s the gym day care.

CASAREZ: Yes, the gym day care.

GRACE: All right. But that`s -- that`s a different story. She`s just putting child there while she goes and works out. OK, I understand that. Tell me again about the date that happened, Jean Casarez, and the date that she said, When he comes to the day care, I want to know about it.

CASAREZ: That`s right. She went to the gym day care thinking he might be working out, and the baby, their baby, would be in the day care. And she wanted to abduct it. Now, that`s the words of the clerk because...

GRACE: But what was that day? What day did she go to the day care to try to find the baby?

CASAREZ: I think it was June 28th.

GRACE: And what day was the restraining order?

CASAREZ: June 28th.

GRACE: All right, there you go, Hugo Rodriguez. And if you just look at it -- I heard what Bremner said, that she hadn`t been served yet. Well, you know what? If she hadn`t been served, it`s a technicality because she clearly knew that...

HUGO RODRIGUEZ, DEFENSE ATTORNEY: No, she didn`t.

GRACE: ... she was going to try to get the baby. Why -- if she didn`t know he was keeping the baby from her, why would she say, Let me know, call me when he comes, I`m going to come get the baby?

RODRIGUEZ: The restraining order had not been served.

GRACE: So?

RODRIGUEZ: She had no idea that it was coming. She did not know it was coming. The restraining order is based on the allegation that she was going to hire somebody six months prior. There was nothing improper with her asking about her child and wanting to see her child. Nothing.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: A search is under way now for 7-year-old Kyron Horman. According to affiliate KPTV, police are back at the area where the 2nd-grade boy vanished from his Portland school.

UNIDENTIFIED FEMALE: Neighbors say the search by detectives has appeared to focus on pick-up truck owners.

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: They`re saying that you failed two polygraph tests. Did you fail two polygraph tests?

UNIDENTIFIED FEMALE: (INAUDIBLE) give us some privacy?

UNIDENTIFIED MALE: Can I please speak with her?

UNIDENTIFIED FEMALE: The only person asked who was asked to take a second polygraph was Terri Horman.

UNIDENTIFIED MALE: In the first failure, I think we were all concerned about it, but it was the behavior immediately following and the build-up to the next one that I think all of us just found completely unacceptable.

UNIDENTIFIED MALE: Why won`t you talk with investigators? Are you cooperating?

UNIDENTIFIED FEMALE: We can`t talk about the details of it, but we passed with flying colors, so...

(END VIDEO CLIP)

GRACE: I am just hearing in my ear as we are going to air that police have gone back to Kyron`s elementary school as we speak. They are going back and they are re-searching the elementary school, looking in every nook, every cranny for something they may have missed.

This is a shot of 7-year-old Kyron Horman, 3-foot-8, 50 pounds, brown hair, blue eyes, thick eyeglasses, was wearing a back T-shirt with "CSI" on it, black cargo pants, white socks, black sneakers with orange trim. His dream was to be a cop.

The wire I`m getting right now, KPTV reporting that cops have looked previously at the elementary school but that they are back. They`re also focusing on people who drive pick-up trucks. Some in the area are saying that their homes have been searched, as well. Police will not comment on the report, but our reports are telling us they are back at the school searching.

I want to go straight back out to Jean Casarez. Jean, I want to talk to you about the alleged kidnap by Terri Horman and the sext messages and these photos. How do they fit into the police investigation?

CASAREZ: Well, it`s all very close in time because Michael Cook, who she allegedly hooked up with four days after Kyron went missing -- that would be in June. The alleged kidnap would have been when that temporary restraining order was filed with the court, before she was served it.

GRACE: To Bruce McCain (ph), former captain, sheriff`s office, attorney also, joining us out of Portland, Oregon. Bruce, weigh in.

BRUCE MCCAIN, FORMER SHERIFF`S OFFICE CAPTAIN: Well, Nancy, the thing that strikes me as most interesting as a lawyer in this case is the role of this family law divorce proceeding because if you look at the very beginning, the divorce itself, the restraining order, the contempt charge, the motion to have Terri moved out of her house, everything associated with this divorce case has been fed by the investigators and the district attorney. It really begs the question as to who`s actually controlling this divorce process as they open up a secondary legal front...

GRACE: Let me ask you something, McCain. Why do I care about the divorce process?

MCCAIN: Because...

GRACE: I care about finding Kyron. Explain to me why that`s even relevant to me.

MCCAIN: Because this is a mechanism to get Terri Horman into court.

GRACE: Ah!

MCCAIN: She cannot ignore this family court law. The prosecutors are the ones who are feeding this information, and they`ve opened up a second legal front against Terri Horman and it`s putting pressure on her and her criminal defense lawyer. She now has to appear in court, answer a circuit court judge in September, if not sooner.

GRACE: Bruce McCain, you are absolutely correct!

(COMMERCIAL BREAK)

DESIREE YOUNG: I`m kind of at that point where I`m so angry I don`t even have words.

UNIDENTIFIED FEMALE: She`s step mom to missing 7-year-old Kyron Horman.

UNIDENTIFIED FEMALE: I`ve about known her a long time.

UNIDENTIFIED FEMALE: Last person to allegedly see him.

UNIDENTIFIED FEMALE: I know she`s lying.

UNIDENTIFIED FEMALE: The father of Kyron Horman, a missing Oregon boy, says his estranged wife has attempted to abduct their 20-month-old daughter.

UNIDENTIFIED FEMALE: She`s still not cooperating.

UNIDENTIFIED FEMALE: In new court documents Kane Horman alleges --

UNIDENTIFIED FEMALE: After Kyron went missing she met and began a sexual relationship with Michael Cook. Who is Michael Cook?

UNIDENTIFIED FEMALE: One of Kaine`s childhood friends.

UNIDENTIFIED FEMALE: I just really want her to do the right thing and I can`t say it enough that Kyron is still out there, and he needs to be home.

NANCY GRACE, HEADLINE NEWS HOST: Back to Anne Bremner and Hugo Rodriguez. First of all, Anne Bremner, when you misquoted me earlier I said get the handcuffs. And I want you to explain to me why it is irrelevant that she is sending hundreds of sexual text messages and exclusive sex photos in the hours after her stepson disappears?

ANNE BREMNER, DEFENSE ATTORNEY: Well, I heard you say get me a hand cuff but at any rate a pair of hand cuffs and it sure sounds like from you, Nancy --

GRACE: The handcuffs.

BREMNER: Okay. Well maybe I misheard over here.

GRACE: Yeah, maybe you did.

BREMNER: Sexting.

GRACE: Yeah, I can`t say that.

BREMNER: Denied having sex. Okay. I`ll say it. They denied having sex. How is that relevant --

GRACE: Anne, Anne, Anne, Anne, Anne.

BREMNER: Let`s assume it`s one of your other guests that --

GRACE: They denied having sex.

BREMNER: That`s right.

GRACE: She`s sending photos over her phone of every body part she`s got.

BREMNER: Those are two -- you know what?

GRACE: He probably didn`t know what it was.

Nancy Grace transcript July 14

Part 1

NANCY GRACE, HOST: Breaking news tonight, live, rural Oregon. Stepmommy walks a 7-year-old little boy down the hall of his elementary school from the science fair. He`s never seen again. Police insist stepmommy take a second polygraph. In a stunning twist, 7-year-old Kyron`s dad files for divorce in secret. The court slapping stepmommy Terri Horman, the last person to see the boy alive, with an emergency restraining order.

It gets worse! Stepmommy ordered to stay away from firearms and from her own children. At police urging, Kyron`s dad moves out of the house, taking the 19-month-old baby sister with him, tonight hiding at a secret location, secret even from Kyron`s stepmother. Kyron`s natural mother breaks down in tears in a public plea, begging stepmommy to please, please help police, insisting she believes her 7-year-old boy is still alive. And in another bizarre twist, we learn stepmommy tries to hire a hit man to murder Kyron`s father, her husband.

Bombshell tonight. Did stepmommy carry on a torrid sex affair after she reports Kyron goes missing, even sending X-rated photos to her alleged lover? Does that sound like a mommy worried sick over her son`s disappearance? No!

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Terri, do you know where Kyron is? Will you tell the world something? Will you please tell the world something?

UNIDENTIFIED FEMALE: ... shocking new allegations...

UNIDENTIFIED MALE: An alleged love triangle ignites shockwaves. Authorities allege...

UNIDENTIFIED MALE: Cook and Terri Horman have exchanged sexually graphic text messages...

UNIDENTIFIED MALE: Stepmom accused in a secret affair with her husband`s long-time friend.

UNIDENTIFIED MALE: His estranged wife has attempted to abduct their 20-month-old daughter.

UNIDENTIFIED FEMALE: I just really want her to do the right thing.

UNIDENTIFIED MALE: It`s only reasonable to assume that people would speculate and become suspicious of Terri.

UNIDENTIFIED FEMALE: I know she`s involved.

UNIDENTIFIED MALE: It doesn`t mean that she had anything to do with it.

UNIDENTIFIED FEMALE: I`m so angry, I don`t even have words.

UNIDENTIFIED FEMALE: (INAUDIBLE) motion has been filed to find his wife in contempt of court.

UNIDENTIFIED MALE: ... completely unacceptable...

UNIDENTIFIED FEMALE: ... not telling the truth.

(END VIDEO CLIP)

GRACE: And tonight, California cops race to a frightening scene, a young wife head prisoner in her own home, beaten, bound with duct tape, under constant death threat and 24-hour surveillance but not by one, two, three, ten, twenty high-tech cameras wired throughout the home. The alleged kidnapper? Her own husband.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Police have arrested a California man after he allegedly beat his wife for talking to a quote, "unauthorized man," then duct taped her and confined her to the bathroom of their home. Police were called after the wife`s friend found her bound and beaten in the bathroom. The victim reportedly told cops her husband would frequently beat her and not even let her leave the house unless she was with him or going to work.

UNIDENTIFIED MALE: There was a lot of emotional (INAUDIBLE) take place in a situation like this, and the method and the mode was extremely brutal, as far as I`m concerned.

UNIDENTIFIED MALE: Cops reportedly found 20 cameras installed throughout the house, the video feed allegedly going straight to the husband`s iPhone. The husband is now facing charges including kidnapping, assault with a deadly weapon, false imprisonment and spousal abuse.

(END VIDEO CLIP)

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight. Did stepmommy carry on a torrid affair after she reports 7-year-old Kyron disappeared, even sending X-rated photos to her alleged lover? Now, this is after the boy goes missing from his own elementary school. Does this sound to you like a mother worried sick about her little boy`s disappearance? No!

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: ... chilling picture of what Terri Horman may be capable of.

UNIDENTIFIED FEMALE: We know the truth.

UNIDENTIFIED FEMALE: ... very amazing allegations...

UNIDENTIFIED MALE: ... an affair with one of Kaine`s childhood friends...

UNIDENTIFIED FEMALE: ... a sexual relationship with Michael Cook...

UNIDENTIFIED MALE: ... texting hundreds of messages, dirty photos while Kyron is still missing.

UNIDENTIFIED MALE: Kaine Horman says his estranged wife has attempt to abduct their 20-month-old daughter.

UNIDENTIFIED FEMALE: What was she focusing on?

UNIDENTIFIED MALE: Herself and how she feels and how the experience was for her.

UNIDENTIFIED MALE: These are not the normal things that people do when you`re searching for a child.

UNIDENTIFIED MALE: Terri, do you have anything to say? Do you have anything to say? Do you know where Kyron is?

UNIDENTIFIED FEMALE: It`s extremely frustrating that she is not cooperating.

UNIDENTIFIED MALE: Can you tell us yes or no?

UNIDENTIFIED FEMALE: She`s still not cooperating. She`s not taking an active role in finding Kyron.

(END VIDEO CLIP)

GRACE: Can somebody bring me the handcuffs? No, she has not been named a suspect in this case, I can tell you that right now. But according to our reports, stepmommy is carrying on a torrid sex affair. This is after Kyron goes missing, after she reports he disappears, sending hundreds of sexts, text messages that are sexually related, and dozens of sexually- related photos. This is not a stepmother who`s worried sick about the disappearance of her little boy!

Straight out to you, James Pitkin, joining us from the "Willamette Week" newspaper. How many more twists and turns is this case going to take before we get an arrest? Tell me about the alleged love affair.

JAMES PITKIN, "WILLAMETTE WEEK": Well, these are bizarre and shocking developments this week, Nancy. Our community here is just in awe over this. She started this affair, according to these court documents, just days after Kaine left the house, taking their 19-month-old daughter with him.

GRACE: We are taking a look at some of the court documents. They clearly state that the stepmom appears to be involved in a relationship, a sex relationship, and it happens to be with a high school friend of Kaine Horman, the father, her husband.

Out to you, Matt Zarrell. Matt, what do we know about all these text messages? How do we know stepmommy has launched affair after the little boy goes missing?

MATT ZARRELL, NANCY GRACE PRODUCER: Well, this information is coming from police, Nancy, because in the court documents, Kaine Horman says that police have told him about this alleged affair and have told him about the phone records, which show hundreds of graphic text messages and photos of Terri Horman sent to this person, Michael Cook, in various stages of undress. Now, this started around June 30 and has continued. Michael Cook has denied that he ever had a sexual relationship with her, but he has admitting to sending sexts to her.

GRACE: OK, Matt, what do we know about the photos? Were the photos sent, what, over her telephone or from her computer?

ZARRELL: From what we understand, they were cell phone records. Police have obtained these cell phone records and informed Kaine Horman on June 30th that these texts were starting to take place. And police looked at it and the explanation they gave is graphic images, various stages of undress.

GRACE: Now, are the alleged photos of Terri Horman, the stepmother, or of the man?

ZARRELL: Now, we believe that there are photos of Terri Horman. Michael Cook has admitted to sending graphic text messages with Terri Horman. We do not know if he sent photos back, Nancy.

GRACE: Now, wait a minute. I don`t understand what you just said, Matt Zarrell. You`re telling me that he sent photos with her? He`s in some of the photos?

ZARRELL: No, he`s -- he admits to sending texts to her, graphic texts to her. We have not seen anything about him sending photos of himself to her. But we...

GRACE: Oh, wait a minute. Wait a minute. Stop, Matt. Hold on. Am I actually seeing the alleged lover, Michael Cook, with a stack of missing Kyron flyers in his hand? Is that what he dares to have in his hand while he is having an affair with the stepmom? Is that who that just was, Matt Zarrell?

ZARRELL: Yes, it is. And apparently, he organized a vigil for Kyron.

GRACE: OK. Lillian Glass, Dr. Lillian Glass, psychologist, body language expert, how can he deny he`s having an affair? And look, I don`t care. I don`t care. Cats and dogs sleeping together. I am not the church lady. But when I am looking at a possible child murder and a confirmed child disappearance, and the person, the stepmother who was with him last, who comes up with a story about him missing from his own elementary school -- she walked him down the hall -- now I find out in the days, the hours after she reports him missing, she`s hot and heavy with her husband`s high school friend, and she`s texting hundreds of messages and nasty photos of herself? She`s not worried about Kyron!

LILLIAN GLASS, PSYCHOLOGIST: Oh, not at all, Nancy. And what`s very, very interesting...

GRACE: Look at this kid, Lillian! Look! Elizabeth, put his picture back up. Look at him!

GLASS: He`s precious.

GRACE: Look at him!

GLASS: Precious.

GRACE: How many thousands of people would want to have a little boy like this? Look at that smile. Look at him!

GLASS: Sure.

GRACE: Those little thick glasses. And she`s out doing this?

GLASS: Well, she`s obviously trying also, Nancy, to do something very bad to her husband. And it`s very interesting, not just the fact that she, we think, maybe got rid of the little boy, but also to hurt the husband emotionally by getting involved with his best friend or his high school friend. That speaks volumes.

There are two things that she`s doing passive-aggressively to get to her husband, and she`s done them both. And it`s really also something to think about. Did she have an affair with this man ahead of time? Even though this is what was discovered on the texts, what was really going on?

GRACE: We are taking your calls. Out to Diane in California. Hi, Diane.

UNIDENTIFIED FEMALE: Hi, Nancy. I totally agree with the lady that was just speaking. To me, it`s totally obvious that they`ve been together for a lot longer than we know because no normal man will want to have sex with someone under these circumstances. That is not normal.

And then my question is, is she violating the restraining order in any way by calling the day care center? And also, I`m connecting Mel Gibson to that lady missing in Malibu, that black lady. And I just had to say that - - that young black woman.

GRACE: OK. I don`t think Mel Gibson is a suspect in that case, but I`m sure the cops have now heard your theory.

OK, to you, Jean Casarez. What can you tell me in answer to her question?

JEAN CASAREZ, "IN SESSION": Well, this is the legal significance of all this, and it does have to do with the restraining order but in another direction. All of this, Nancy, has come about because Kaine Horman is alleging that his wife, Terri Horman, has -- in contempt of court, that she violated the restraining order. That was sealed. No one was to see it. But yet Michael Cook has admitted he went over to the house and his cell phone photograph (ph) per (ph) to that restraining order when it was sealed, notably the address of where Kaine Horman and Kiara were living.

Kyron Horman update: Desiree Young says Terri Horman planned Kyron’s disappearance (video)

Jane Velez-Mitchell transcript July 14th

Part 4

VELEZ-MITCHELL: Fast breaking news in the desperate search for little Kyron Horman. As we speak, cops in Oregon have returned to the scene of the crime. And they are once again searching high and low in the area near Kyron`s school.

This adorable 7-year-old boy vanished from inside his school hallway more than a month ago now. And tonight, local reports say cops are questioning anyone in the area who owns a pickup truck and on top of that, they`re allegedly searching for a certain family -- certain family?

Could this be a major break in the case? Meanwhile the walls continue to crumble around Kyron`s stepmom. His biological mother now says Terri Horman, the stepmother wasn`t just involved, bio-mom insists the stepmom carefully planned and plotted the kidnapping.

Listen to what she told NBC`s "Today" show.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Do you think Terri Horman planned to do something?

DESIREE YOUNG, KYRON`S MOTHER: Something that Terri Horman -- oh, yes, without a doubt. I think it was very planned.

UNIDENTIFIED FEMALE: Ahead of time?

YOUNG: Oh, yes.

UNIDENTIFIED MALE: We absolutely believe that Terri Horman is responsible for Kyron`s disappearance.

(END VIDEO CLIP)

VELEZ-MITCHELL: Wow. Talk about not holding back. There are plenty of allegations. But is there any proof? Remember, Terri Horman is not considered a suspect or a person of interest.

I`m bringing back my fabulous panel, former police officer Marc Harrold. We begin with you. What would make cops return to the scene and look for a certain family? That is bizarre to me.

MARC HARROLD, FORMER POLICE OFFICER: Well, it does seem like they have some new information. I`m not exactly sure what it is. But given that and given the fact they may have already had this information, they just did not release that they were looking for a particular family. But it sounds like with returning to the scene, some physical evidence they`re looking for, the pickup truck and actually saying that they are looking for certain people, they probably do have some information.

But I don`t have any way of knowing.

VELEZ-MITCHELL: Well, I`m sure they have information, Harold.

Mark Eiglarsh, I guess what I`m getting at is, let`s use some deductive reasoning. Let`s take out our pipe and our Sherlock Holmes hat and try to figure out what this is all about. Because --

EIGLARSH: Right, because I own one of those.

VELEZ-MITCHELL: -- yes of course, you should.

EIGLARSH: I`ve got one.

VELEZ-MITCHELL: You`ve got a stepmom here who purportedly, according to documents that have been filed, allegedly tried to hire a hit man to rub out her husband who fled the home.

EIGLARSH: Yes.

VELEZ-MITCHELL: And then you have her supposedly starting up an affair with some guy that she met after the little boy went missing. And texting him sexy text messages as well as graphic sexual images. And now we`re hearing they`re looking for a certain family? That doesn`t match the previous two things we`ve heard.

EIGLARSH: Right. And first and foremost, she was the last one to see the boy. Let`s start there. Jane, they don`t have to call her a person of interest. They don`t have to call her a suspect. She is the number one. She`s the one they`re looking at.

The problem, however, is if what we`ve heard is all of the evidence, while it looks to the average person like she`s really, really, really guilty, it`s not proof beyond a reasonable doubt. This would get dismissed in court because there`s another hypothesis of innocence that could be put out there.

So they need more in this case, Jane.

VELEZ-MITCHELL: They sure do.

Lynn, Canada, your question or thought, ma`am?

LYNN, CANADA (via telephone): It`s great to talk you, Jane.

VELEZ-MITCHELL: Thank you.

LYNN: My comment is, it seems -- what`s the connection with her son being sent back with apparently the child`s father or grandparents? Then her husband -- she has a hit man out on her husband. And this little boy is gone missing. Has the police ever questioned her son?

(CROSS TALKING)

VELEZ-MITCHELL: Well, I think -- I think that`s very interesting that you mention that, because, yes, Terri Horman has a 16-year-old son from a previous marriage. And that boy had reportedly been living with the two people you`re looking at there, Terri and Kyron`s biological dad.

And then at some point in the recent past, that 16-year-old reportedly left the home and went to live somewhere else, perhaps with his biological father. We don`t know.

I think it is interesting that all these changes were happening within the household shortly before, Dr. Dale Archer, little Kyron disappears.

ARCHER: Yes. And I think that that we can all link that together, because first of all, she tries to hire a hit man, allegedly and that didn`t work. So then she turns to an easier target that would be Kyron and she could handle that on her own.

And then after that breaks, there`s the sex thing to Michael Cook. But that`s not about sex. She wanted to use him for something and we don`t know what that is. And it probably got short circuited before she could develop it.

But this is a woman that clearly uses men and she uses sex, or sexual favors, or a promise of that in order to get them to do what she wants. And I think Kaine probably fell into that category early on. But then I think when the child was born, the daughter -- 18-month-old daughter was born, that he started pulling away.

VELEZ-MITCHELL: All right.

ARCHER: And that`s when she broke narcissistically.

VELEZ-MITCHELL: Doting housewife or evil stepmom, initially Terri Horman was painted as the perfect stepmom, always happy, involved in Kyron`s life. Now Kyron`s biological mother is telling a different story.

Listen to this. Check this out.

(BEGIN VIDEO CLIP)

YOUNG: Kyron became increasingly unhappy about not spending time with me. He wanted to come and live with us. Several times he would just break down and just sob, because he wanted to stay.

(END VIDEO CLIP)

VELEZ-MITCHELL: So Mark Eiglarsh, now we`re hearing that the little boy was not happy living with the stepmother and that he would sob when he had to leave his biological mother`s home.

EIGLARSH: I can`t imagine what that must be doing for the family to think that he wasn`t happy. And if they had heard that, they could have done something. You know, it`s not fair for them to -- to make themselves feel that way but I`m sure that that`s on their minds.

ARCHER: You know what?

EIGLARSH: It`s really unfortunate.

VELEZ-MITCHELL: Go ahead.

ARCHER: You know, I just want to say that kids are very, very intuitive. And so clearly Kyron knew that something was up. Things weren`t right and kids sense that. They may not be able to verbalize why, so I think that that explains why he was feeling the way that he did.

VELEZ-MITCHELL: An eyewitness has come forward. Terri Horman is accused of trying to kidnap her own daughter while her husband was out working. Tonight the owner of the gym is speaking out. Listen to this.

(BEGIN VIDEO CLIP)

BOB BRIEDE, XTREME EDGE GYM: Her behavior was definitely suspicious, and I felt that it justified making a phone call to the authorities. Somebody needed to know about that just in case there was something there, you know. I sure wouldn`t want two kids to go missing.

(END VIDEO CLIP)

VELEZ-MITCHELL: Just to explain that, according to Kyron`s dad, when he was working out at the gym, he left his little daughter at the gym day care and that`s when Terri purportedly came in and was trying to find out when he would be working out and he believed that was to snatch the child.

All right. Stay right where you are. The latest on Mel Gibson`s alleged meltdown, right after the break.

(COMMERCIAL BREAK)

VELEZ-MITCHELL: More alleged Mad Mel audiotapes, another shocking reporting hits the web. And I mean shocking, people. Oksana Grigorieva says the spitting mad, lunatic screaming at her on this tape is her hot shot Hollywood ex, Mel Gibson. Oksana who has an 8-month-old baby daughter with Mel fruitlessly tries to calm the furious man who`s berating her and he goes ballistic, ranting, panting and threatening to burn the house down.

Check this out from RadarOnline.

(BEGIN AUDIO CLIP)

UNIDENTIFIED MALE: How dare you act like a (EXPLETIVE DELETED). I swear I`ll burn the (EXPLETIVE DELETED) house down. You`re a pain in my (EXPLETIVE DELETED). Stop being that.

(END AUDIO CLIP)

VELEZ-MITCHELL: Oh, boy. Police are investigating Mel for domestic violence due to Oksana`s claims that he punched her in the face, breaking her teeth which he denied. Is Oksana`s dentist the key to this case?

And now, a new report out saying that dentist has photo graphic proof; apparently, allegedly, pictures of a battered, bruised, broken, ashamed Oksana.

CNN has not been able to verify the voice on these tapes is in fact Mel. We have reached out to Gibson`s camp. So far, they have not commented. They`re always invited on the show at any time to tell their side.

Straight out to Dylan Howard; Dylan, RadarOnline is all over the story. What is the very latest?

DYLAN HOWARD, RADARONLINE: Well, we reported today exclusively on RadarOnline more details, chilling details, Jane, about what happened in the immediate aftermath to when Mel Gibson hit his baby mama Oksana Grigorieva.

Now we`re told Oksana ran out into the backyard. Mel disappeared into his bedroom. She ran back into the house searching for her key so she could escape the Malibu mansion and that`s when Mel Gibson, according to the statement that Oksana Grigorieva provided to law enforcement official, Mel began waving gun in her face.

He chased her outside. As she got into the car and he said, "I know one quick way to get you out of here." Another alleged death threat from Mel Gibson directed to his baby mama, hot off the heels of more explosive audio recordings in which he`s heard threatening to blow down the house but not until she performs oral sex on him first -- disgusting stuff.

VELEZ-MITCHELL: All right. I have to say HLN has not been able to independently confirm anything about this gun. Police aren`t confirming it. You`re the only ones reporting it.

And Mel Gibson`s camp has pointed out in the past that Oksana did not call 911. So how did you get this information?

HOWARD: We got this from sources closely connected to the law enforce management investigation probing that January case. And we are not the only ones to report that it ought to be noted, Jane. The gun claim is one of just a series of claims that Oksana Grigorieva is making.

But interestingly enough, these are claims that she has leveled to the Los Angeles Sheriff`s Department.

VELEZ-MITCHELL: I have to say, listening to these tapes, if it is Mel the thing that strikes me is sort of underlying misogyny and hostility toward women throughout all of it. What are your thoughts without getting too graphic?

HOWARD: Well, these are crazed rantings. I don`t think we`ve ever heard anything like this, especially from the ilk of a Hollywood A-Lister. That`s what makes this so frightening.

Now, clearly Mel Gibson is aggrieved (ph) in all of those. We don`t know why he hasn`t come forward to provide any reasonable explanation. What we think, perhaps maybe he did.

VELEZ-MITCHELL: And we`ve got to leave it right there. Dylan, you`re fabulous. Thank you.

You`re watching ISSUES.

Jane Velez-Mitchell transcript July 14th

Part 3

MCARDLE: We are desperately, desperately crying for help here. And I`ve spoken to maybe two officers that have been really, really nice and tried to help me. But they can only do so much. We need the police force to do what they need to do to help us find my niece.

And it`s just horrific. It`s -- one police station, "It`s not our jurisdiction." The next police station, "We can`t give you this information, because it`s not our jurisdiction." Well, damn it, whose jurisdiction is it?

VELEZ-MITCHELL: Well, let`s at least clarify whose jurisdiction it is. Who is handling the case? Somebody give us a call back. We`re going to stay on top of this and keep this story alive. Thank you, fantastic panel.

More on Kyron Horman next.

(COMMERCIAL BREAK)

VELEZ-MITCHELL: In the "Spotlight" tonight, a dramatic day ahead in Casey Anthony`s murder case. Her mom, Cindy, and her brother, Lee, are set to take the stand tomorrow. ISSUES will have full coverage of tomorrow`s highly anticipated hearing. Crucial evidence hangs in the balance here. Will a jury ever get to hear Cindy`s incriminating 911 call.

(BEGIN VIDEO CLIP)

C. ANTHONY: My granddaughter has been taken. She has been missing for a month. Her mother finally admitted she`s been missing. Get someone here now.

UNIDENTIFIED FEMALE: Your daughter admitted the baby is where?

C. ANTHONY: That the babysitter took her a month ago. My daughter has been looking for her. There`s something wrong. I found my daughter`s car today, and it smells like there`s been a dead body in the damn car.

(END VIDEO CLIP)

VELEZ-MITCHELL: Imagine if Cindy`s own words helped convict her own daughter of murdering little Caylee, her own granddaughter. Prosecutors say the three 911 calls reveal Casey`s progression of lies after little Caylee vanished. But the defense says the calls are hearsay and should be kept out of the trial. What will the judge decide?

(COMMERCIAL BREAK)

VELEZ-MITCHELL: Welcome back, fantastic panel. But first to "In Session" correspondent Jean Casarez.

Jean, what can we expect from tomorrow`s big hearing?

JEAN CASAREZ, CORRESPONDENT, "IN SESSION": The big thing tomorrow is going to be the 911 calls. The defense is making a concerted effort to try to keep them out of the trial. They don`t want the jury to hear these calls.

But the prosecution is firing back, because they`re saying, No. 1, we only want the first one and the third one. And the first one we don`t want it for the truth of what Casey is saying; we want it for the impact of Casey Anthony to hear it. Because the prosecution says it wasn`t until after that first call that Casey developed the story of Zenaida Gonzalez, and that showed her consciousness of guilt. And that`s the pivotal issue right there.

The third one they say, if we offer it for the truth, it`s an excited utterance, that Cindy said the dead body in the car, that she was talking to law enforcement unexpectedly, spontaneous statement, and that is truthful.

VELEZ-MITCHELL: Dr. Dale Archer, the reason the prosecution wants these 911 calls in, is it 99 percent of communication is not just about the words; it`s about the passion with which you say them? When the mother says, "There`s something wrong here," it really tells the whole story without having to tell the story.

ARCHER: Well, there`s that, Jane, but also there`s the fact that, when you`re under stress and duress, you do say a lot of things that you wouldn`t normally say.

But here`s the deal: they are usually true. When you`re stressed, you don`t have time to think about a lot. You usually say the first thing you think about, and usually that`s accurate.

So you know what? I think these tapes are real, and I think the emotion is real. And I think that they are hugely powerful for the prosecution. Big, big damage control for the defense.

VELEZ-MITCHELL: All right. Mark Eiglarsh, you`re the former prosecutor and criminal defense attorney. I mean, some of the headlines from these tapes: it smells like a dead body in the damn car. My daughter admits now that the babysitter took the child a month ago. And apparently there`s also references to her having taken the car when she shouldn`t have taken the car. In other words, it wasn`t really her car to take. It was her mom`s car.

How is this going to help the prosecution, and do you think it`s going to be allowed in?

EIGLARSH: I think it will be allowed in. And I think it`s going to help the prosecution. Not for all the reasons that you mentioned. Those are like No. 2, No. 3, No. 4.

The No. 1 reason is that the defense wants the jury to think that the person sitting behind the accused always believed her, always supported her, and always thought that there was nothing fishy about the story. From the 911 tape, we`ve all concluded, my God, Cindy even questions her own daughter.

VELEZ-MITCHELL: Hold on...

EIGLARSH: And that`s what you get out of it.

VELEZ-MITCHELL: More on the other side. Is Cindy going to be able to handle it?

(COMMERCIAL BREAK)

VELEZ-MITCHELL: Head-spinning developments in the case of missing Oregon boy, Kyron Horman. Was his disappearance a carefully planned plot? That`s what his distraught mom believes. She says she`s haunted by warning signs and believes Kyron`s stepmom, Terri, plotted his disappearance.

Meantime, Kyron`s dad is taking Terri to court as a new search gets under way for the missing child.

Plus, just when you thought it couldn`t get any more obscene. Yet another alleged Mel Gibson audiotape takes it to a whole new level.

You`ll hear the latest in a dramatic series of vicious tirades. Tonight, do these tapes reveal a star who could be a danger to himself?

Tonight, Casey Anthony`s lawyers frantically preparing for a huge day in court tomorrow. We`re going to cover it here on ISSUES. They want Cindy Anthony`s desperate chilling 911 calls dropped. The defense says Cindy was acting when she said her daughter`s car smelled like a dead body. They say she wanted law enforcement to come to her house in a hurry. That`s why she said that.

But George Anthony also later said the car smelled like a dead body. Check this out.

(BEGIN AUDIO CLIP)

GEORGE ANTHONY, CASEY ANTHONY`S FATHER: I got within three feet of my daughter`s car. And the worst odor you could possibly smell in this world. I`ve smelled that odor before; it smelled like a decomposed body.

(END AUDIO CLIP)

VELEZ-MITCHELL: And George told that to police at the station. Will that 911 call be dropped?

Straight out to Holly in Arkansas, your question or thought, ma`am?

HOLLY, ARKANSAS (via telephone): Well, first of all, I love your show.

VELEZ-MITCHELL: Thank you.

HOLLY: What I want to know is, not an everyday person, I know Casey Anthony`s dad has smelled dead bodies but an average person would not know what it smelled like. So how does her mother know what it smells like when she called 911 that day?

VELEZ-MITCHELL: Well, think one of the reasons is that everybody, when they smell that particular smell, it`s almost instinctive. Even if you`ve never smelled a dead body before, it`s a new and frightening smell that --

MARK EIGLARSH, CRIMINAL DEFENSE ATTORNEY: A former nurse, too. She`s a former nurse.

VELEZ-MITCHELL: Go ahead, Dr. Dale.

DR. DALE ARCHER, CLINICAL PSYCHIATRIST: Yes. I think you hit the nail on the head, Jane. It`s in our DNA. It is absolutely instinctive. It is stored. And when you smell that smell, even if you never smelled that smell before, you know, first of all, you know it`s something bad, and you know it`s associated with death. I agree with you on that.

VELEZ-MITCHELL: We will be watching tomorrow to see if Cindy Anthony can keep her cool on the witness stand. Remember this?

(BEGIN AUDIO CLIP)

UNIDENTIFIED MALE: That`s all I have.

CINDY ANTHONY, MOTHER OF CASEY ANTHONY: You know, you slandered me on TV.

UNIDENTIFIED MALE: Stop.

CINDY ANTHONY: And you perjured yourself with this.

UNIDENTIFIED MALE: Stop.

CINDY ANTHONY: Because she`s not Fernandez. So there you go. You want to fight it? Go for it.

(END VIDEO CLIP)

VELEZ-MITCHELL: Ok. That was a civil deposition. But Jean Casarez, you cannot act like that in criminal court. Do you think Cindy will keep it together tomorrow on the stand?

JEAN CASAREZ, CORRESPONDENT, "IN SESSION": I do. I do. This is a court of law. Judge Belvin Perry, the chief judge is presiding at this point in the trial. And I definitely think, but it will be a dress rehearsal, I think, for both sides because this is a star witness for the prosecution. It will be interesting to see how she does or how the questions are fielded.

VELEZ-MITCHELL: I mean, really, this is a preview of the trial.

CASAREZ: Yes.

VELEZ-MITCHELL: This is a huge day tomorrow because the defendant`s mom, who is at the center of the storm, is going to take the stand and be grilled. It`s really extraordinary.

Now, Casey`s brother, Lee, is also expected to testify tomorrow. Will he be able to continue acting like the good brother? Remember, Casey has purportedly accused him of fondling her breasts. This came up in a letter that was released in the document dumps. Now he`s going to have to get up on the stand and defend his sister?

That`s got to be emotional torment, Dr. Dale Archer.

ARCHER: Yes, I think so. You know, I`m going to be very curious to see what type of tack Cindy in particular takes. Because I think that her testimony and that tape could be absolutely -- just a huge blow against her daughter. And she said all along she doesn`t think she did it. She supports her 100 percent. So she`s going to have to come up with some explanation if that tape is allowed. And I`m going to be very curious to see what that is.

VELEZ-MITCHELL: Nick, New York, your questions or thoughts, sir?

NICK, NEW YORK (via telephone): Hello, Jane, it`s an honor to speak to you again.

VELEZ-MITCHELL: Thank you.

NICK: Hello?

VELEZ-MITCHELL: Yes, hi. What`s your question, Nick?

NICK: Yes. The question that I have is that, I`m having a lot of problems with, you know, I don`t want to rush to judgment. But I have a problem as far as like Casey Anthony, like her actions when her daughter was missing. I mean, first of all, she goes dancing at bars and she buys beer at Target.

I mean if anybody`s child is missing, I mean, you would be upset, like you couldn`t eat. Like you would be going to the police stations every day; it`s just that -- it`s just her actions. I have a lot of problem with Casey`s actions the thing is that it`s --

VELEZ-MITCHELL: You`re looking at the pictures right here, by the way, Nick, of Casey`s so-called dirty dancing. I believe this is during the time that her daughter Caylee was missing. She later explained that she was going to nightclubs to look for her daughter.

It doesn`t look like she`s looking for her daughter there, Mark Eiglarsh.

EIGLARSH: Jane, that is going to be the centerpiece of this trial. Not only was she out dancing, but she got a tattoo. And it`s called "the good life", living the good life. Who does that when their child is missing? She`s not conducting any search.

So DNA evidence, perhaps that might be called into question; but these actions, reprehensible -- no way.

VELEZ-MITCHELL: Today was also a very big day for the defense`s dream team of forensic experts. They put on gowns, they put on masks and a den of crucial pieces of evidence. And they did it firsthand. They paid special attention to Casey`s car.

Remember this? Investigators found traces of chloroform. They found evidence of human decomposition in the trunk. Along with a hair that purportedly corresponds to some Anthony family member but showed signs of decomposition. The only person who was dead in the family that it could apply to would be Caylee Anthony, according to prosecutors.

Jean Casarez, what do you know about what the defense dream team did today with their much heralded examination, physical examination of the evidence?

CASAREZ: You know what`s so interesting, Jane, the defense is really targeting into the areas that they don`t want in this case. The 911 call is one. This car is another one.

Now, Dr. Lee, Henry Lee, already made an assessment of that car. He even found, I think, a hair or two that forensic evaluators on the side of the prosecution had not found. But they`re going to try to disassociate Casey Anthony and the decomposition. That`s going to be their focus from that trunk because the air samples showed signs, according to the prosecution, of decomposition.

VELEZ-MITCHELL: And Mark Eiglarsh, there was a huge battle over how this examination of the physical evidence could occur. Remember, the defense didn`t want anybody from the Sheriff`s Department there.

I read today that the sheriff`s department was actually videotaping them. And that if they wanted to talk amongst themselves, they had to go away in a separate room. Does that sound like putting pressure on the defense so they can`t really effectively analyze this evidence because they know eyes are upon them?

EIGLARSH: Well, that`s what the defense would argue. I`ve argued that before. But what they`re saying is they`re simply maintaining the integrity of the evidence. The defense is going to question every single piece. And they don`t want anything disturbed.

So they`ve got to keep their eye on them. It`s their position. They want to videotape, make sure nothing was touched. Jose didn`t take something off something and put it over here. And, you know, I understand why they`re doing it.

VELEZ-MITCHELL: Carol, Texas, your question or thought, ma`am?

CAROL, TEXAS (via telephone): Hi, Jane.

VELEZ-MITCHELL: Hi.

CAROL: I would like to -- way back when this first started, I really, really, really watched it. Casey Anthony had stated that her brother had sexually abused her, as well as her father. And then she recently got a letter stating that her father was poking fun that she`s getting fat in jail.

And I want to know if her little dream team, now that one of her good lawyers is no longer on the team, if they`re going to pull this, you know, she was sexually abused. They were spending all this time on little -- the little girl; she didn`t want that to happen.

VELEZ-MITCHELL: Good question. We don`t know where these trials go. This is runaway freight train. And as we saw with other high-profile cases like the O.J. Simpson case, you never know where it`s going to take us. It`s going to be an adventure. We just hope justice is the final stop.

Thank you so very much, excellent panel.

Meantime, so many of us are completely outraged about the Gulf oil spill. So where is the outrage from celebrities, like the ones who were screaming during Katrina? ISSUES viewer Mike Andrews is going off on his own ISSUES rant. Check it out.

(BEGIN VIDEO CLIP)

MIKE ANDREWS, VIEWER: The day-to-day American, I`m not sure if they`re relating to what`s happening down there. What I would like to see, I know this is small, and a lot of people might not agree, but I want to see more celebrities onboard with what`s going on.

You know what I`m saying? I want to see -- you know, they can`t fix the problem, I understand that. There`s very little they can do to actually effect the issue in terms of stopping the oil. But we all know how important it is to be aware, how important it is for people to know what`s going on.

(END VIDEO CLIP)

VELEZ-MITCHELL: All right. Mike, way to go. Thank you for sending in your ISSUES rant.

Are you at home as outraged about an issue that you see on this show? Send us a video rant. It can be about any story that gets your blood boiling.

Send your ISSUES rants to Jane@cnn.com; please try to make it 30 seconds or less, speak loudly. Use your outdoor voice and speak into your web cam. And make sure there`s some good lighting so you look fabulous.

We want to hear from you. Send them in and we`re going to air the most passionate ones live.

All right. We`ve got to ask, the Mel Gibson drama continues.

And we`re first going to go to Kyron, was Kyron`s kidnapping carefully planned. Tonight cops return to the scene of the crime. Those stories next.

Jane Velez-Mitchell transcript July 14th

Part 2

VELEZ-MITCHELL: The missing woman`s family was shown surveillance tape from the Camden train station where Jenna was last seen. Now, tell us what you saw, Desiree. Did Jenna ever get on that train? And what about these two mysterious men who were apparently standing near her?

CARUSO: Right. The picture that I`ve seen, it was of Jenna walking, and then you seen two African-Americans walking behind her. But they were like, I would say like 10 -- maybe five feet behind her. And it looked like they -- that they were saying stuff to her. She wasn`t talking to them. Like, it looked like she looked back when they were saying something. And then she just kept walking, and that`s the end of the tape.

VELEZ-MITCHELL: I want to bring in -- hang in there, family. We`re trying to help out here. Mark Harold, former police officer. What do you make of this situation, Mark, and the apparent lack of responsiveness by the police?

MARK HAROLD, FORMER POLICE OFFICER: Well, it doesn`t seem like much information`s coming out, obviously, at least to the family. There may be some jurisdictional issues. I`m not exactly sure why, unless they`re saying that she got on a train and went somewhere else.

But all the factors of her past are relevant in trying to recreate patterns and understand where somebody may or may not go, what kind of people they may have contact with and that sort of thing. So it`s relevant information, what she may have been involved with in the past, but it certainly shouldn`t cause the police not to take the case as seriously. So that`s unfortunate if that`s what`s happening.

But it doesn`t sound like we have much information from law enforcement to really understand what their role is so far.

VELEZ-MITCHELL: Kimmy McArdle, you`re the aunt of the missing woman. You apparently have been -- have you been to this train station? Do you know what it`s like in that area?

MCARDLE: I have not, unfortunately. I`ve been trying to all do the legwork.

VELEZ-MITCHELL: Let me ask Desiree. Have you ever been to this train station?

CARUSO: Yes, I have.

VELEZ-MITCHELL: OK. What`s it like there?

CARUSO: It`s disgusting. It`s disgusting. It`s bad. It`s...

MCARDLE: Corrupt.

CARUSO: It`s -- they should shut it down. They should shut Camden down. Bad.

VELEZ-MITCHELL: Because...

CARUSO: It`s scary.

VELEZ-MITCHELL: ... it`s dangerous? We know that Camden is a very dangerous city.

CARUSO: Right.

VELEZ-MITCHELL: I mean, that has been established by statistics. It ranks on the top or close to the top all the time. So you`re saying that this train station in Camden is a dangerous place within a dangerous city?

CARUSO: Right.

VELEZ-MITCHELL: So -- but she was there at 7:20 in the morning, right, is when she called you?

CARUSO: Right.

VELEZ-MITCHELL: And yet you don`t think she got on the train. What evidence do you have that she did not get on the train?

CARUSO: She just -- if she got on the train, she would be home. If she -- I mean, she would be home with us if she got on the train. I don`t care what she`s doing. She would have called my mom. She would call my sister. She would call me. She would call Ed.

VELEZ-MITCHELL: Well, the train was headed to Philadelphia, right?

CARUSO: Right.

VELEZ-MITCHELL: OK. So it`s always possible that she got on the train and something happened to her in Philadelphia.

STEELE: Yes, but I went down 15th and Market, in Philly, and handed out fliers everywhere. No one`s seen her. She never got on -- she couldn`t have got on the train. At first I thought she did, but then when they were saying these guys were following her on the tape, and this guy on the phone saying some guy came up to her, make sure she got on the train all right, something happened.

VELEZ-MITCHELL: Say that again? You just said something significant. You said the guy on the phone who lent her his cell phone...

STEELE: Yes.

VELEZ-MITCHELL: ... said to you what about another person?

STEELE: He said some guy came up, because he had to get on his train first. And he said that some guy came up and said he`ll make sure that she gets on the train. He`ll make sure she gets on the train all right.

MCARDLE: He said, "I got this."

VELEZ-MITCHELL: Wow. He said, "I got this"?

CALLER: "I got this."

VELEZ-MITCHELL: Well, that`s -- that`s certainly a disturbing piece of information.

MCARDLE: Yes, it is.

CARUSO: Right.

VELEZ-MITCHELL: "I got this." Wow. OK. Well, that`s new information. I wonder if the police know about that. Does anybody in the family know if the police know about this?

CARUSO: I don`t -- like, as far as the police, like they told me -- when I called Collingsworth, Collingsworth told me that I had to file a missing persons where I live, which is Collingdale. And so I did. And now Adams is saying that it should be Jersey`s problem, not Collingdale`s.

VELEZ-MITCHELL: I have to talk to the aunt for one second. Kimmy, what are your concerns when you hear that a strange man walked up and said to the other man who had lent the phone to Jenna, "I`ve got this," referring to Jenna?

MCARDLE: It`s disturbing, because you would think somebody would say, "Oh, I overheard what you were talking about, and, you know, you`re waiting for the next train. Well, I`ll see to it that you get on the train."

You don`t go up to somebody and say, "Oh, I got this." What have you got? That`s what I want to know. It`s disturbing; it`s scary. "I got this"?

VELEZ-MITCHELL: Well, if there is -- we`re going to take a break for a second here, but if there`s video of her on the train station, then perhaps there`s video of that individual. Perhaps we should have a photo to put up on those individuals, if police are looking for them.

But again, police aren`t calling us back. So we can`t say if those are the individuals or an individual they`re looking for. Call us back, law enforcement.

More on Jenna`s disappearance in just a bit.

Plus, expert witnesses scoured through evidence in Casey Anthony`s car today. What are her attorneys focusing on, and did they get the crucial proof they need to prove Casey`s innocence?

(BEGIN VIDEO CLIP)

GEORGE ANTHONY, CASEY`S FATHER: Shut up.

CINDY ANTHONY, CASEY`S MOTHER: No, I`m not shutting up. You`re telling me I can`t pray?

G. ANTHONY: I didn`t say that.

C. ANTHONY: Yes, you did. You went...

G. ANTHONY: Shut the door, please.

C. ANTHONY: You`re telling me I shouldn`t be praying. We`re out of here.

UNIDENTIFIED MALE: How did it go in there today?

C. ANTHONY: (UNINTELLIGIBLE)

(END VIDEO CLIP)

(COMMERCIAL BREAK)

VELEZ-MITCHELL: Tonight, missing in America. What happened to 23- year-old Jenna Lord? She was last seen in a New Jersey train station on the Fourth of July holiday. Are police doing everything they can to track her down?

We`ve been calling the cops all day. They haven`t called us back. The family also says they`re getting the run-around. "The Philadelphia Daily News" also says they`re getting the run-around. Why?

Beth in New Jersey, your thought or question, ma`am?

CALLER: Hi, Jane.

VELEZ-MITCHELL: Hi.

CALLER: My name`s Beth, and I`m calling from New Jersey. I live in Cherry Hill.

VELEZ-MITCHELL: OK.

CALLER: Jenna does not look familiar to me, but I do know that train station. I know all about it. It`s a drug hub. I had somebody in my family with an addiction problem, and we needed to go down there and rescue him a few times, so I know all about that. She could very easily, you know, have been taken from there.

VELEZ-MITCHELL: Wow. I have to throw this out to Dr. Dale Archer, psychiatrist. You`ve been listening to all of this. What do you make of it?

DR. DALE ARCHER, PSYCHIATRIST: Well, I think several things. First of all, the behavior of the police is just very, very concerning. And I think a mantra that I use with my psychiatry patients is that everybody counts or nobody counts. And why they`re acting the way they do, I don`t know. But they need to understand that the media can be their best friend in a case like that. That`s No. 1.

No. 2, I do know about Camden. It has a horrific crime problem. I really wonder why she would be there by herself at that train station, because it`s not safe at all.

All that being said, though, I think that the suspicion has to fall to the guy that said, "I got this." And also the guy whose cell phone she used. I don`t think he can be let off the hook either.

VELEZ-MITCHELL: Mark Eiglarsh, obviously the caller is saying perhaps she went there for the purposes of scoring drugs. You hear her family is saying that she was clean and sober for several months. Could that be the reason why police may be less aggressive on this, apparently, than they might be, because they`re connecting the dots? But what if, for some reason, she`s wrong -- they`re wrong and she just happened to be there and was sober?

MARK EIGLARSH, CRIMINAL DEFENSE ATTORNEY: Yes, it shouldn`t be a reason, Jane. As Dale pointed out, everybody matters.

But there`s too little that we know about their position to draw the conclusions that we are. At a minimum, they have screwed up big-time in the P.R. department.

And it`s not necessarily to the media that I`m offended they have not necessarily opened up their arms, but it`s to the family. At a minimum step forward and say, "We`re doing everything that we can for your daughter." And that`s it. And they haven`t done it. And that`s reprehensible.

VELEZ-MITCHELL: Now, is Kimmy back on the phone, the aunt?

MCARDLE: Yes, I`m here.

VELEZ-MITCHELL: OK. We just heard that the -- Eric, the guy that lent her the cell phone, said that some other guy approached her and said, "I`ve got this," in reference to your niece. Do you know if police have videotape of that individual? Do you know if police have interviewed Eric? What have you been told?

MCARDLE: Absolutely nothing.

VELEZ-MITCHELL: Nothing?

MCARDLE: Nothing.

CARUSO: No.
